Acceptance of these terms.
These Terms of Service ("Terms") govern your access to and use of the website located at americanexecutivesecurity.com and any pages, features, or content within it (the "Website"). The Website is operated by American Executive Security ("AES," "we," "us," or "our"), a physical-security services company based in Falls Church, Virginia.
By accessing or using the Website, you agree to be bound by these Terms and by the Privacy Notice. If you do not agree, please do not use the Website. If you are using the Website on behalf of an organization, you represent that you are authorized to accept these Terms on that organization's behalf.
What the Website is, and is not.
The Website is an informational and marketing site. It describes AES, its physical-security services, the industries and geographies we work in, and the questions to think through before an engagement begins. It also allows you to submit a prospective-client enquiry.
The Website is not itself a security service. No physical security is provided by visiting the Website, submitting an enquiry through it, or reading its content. Submitting an enquiry does not deploy an officer, initiate a patrol, or place any part of AES on call.
An enquiry is not a service agreement.
Completing the enquiry form or otherwise contacting us through the Website initiates a conversation. It does not create a contract for security services. Any AES engagement is confirmed separately in a written proposal, statement of work, or service agreement signed by AES and the client. Scope, coverage period, staffing, rates, and other operational details are agreed in that separate writing and are not established by any content on the Website.
Intellectual property.
All content on the Website — including text, page structure, visual design, illustrations, photographs, logos, marks, icons, and code — is owned by AES or its licensors and is protected by United States and international intellectual-property laws.
You may view Website pages, print reasonable excerpts for personal reference, and share links to public pages. You may not copy, reproduce, republish, distribute, modify, translate, or create derivative works from the Website's content in whole or in substantial part, use it to train a machine-learning model, use it in another commercial offering, or use any AES marks in a way that could suggest sponsorship, affiliation, or endorsement, without prior written permission from AES. Requests to reuse material or reference marks should be sent to info@aesecurityinc.com.
Illustrative imagery disclosure.
The photographs, portraits, uniforms, vehicles, buildings, and scenes shown on the Website are AI-generated illustrative concepts. They are not verified AES personnel, clients, engagements, uniforms, or locations. They are provided to communicate the general character of the services described. Nothing in the imagery should be interpreted as a claim about a specific person, address, event, or assignment. For further detail, see the image information page.
Acceptable use.
When using the Website, you agree not to:
- Use the Website in a way that violates any applicable law or regulation.
- Attempt to gain unauthorized access to any portion of the Website, its infrastructure, or any related system.
- Introduce viruses, worms, or other malicious code, or otherwise interfere with the operation of the Website.
- Use automated means to scrape, index, or reproduce the Website in a way that goes beyond ordinary search-engine indexing.
- Submit false, misleading, or infringing information through the enquiry form, or submit information belonging to another person without their authorization.
- Use the Website to send unsolicited commercial communications, harassment, or threats to AES or any third party.
Third-party links and resources.
The Website may link to third-party websites and services (for example, mapping tools, industry associations, or government resources). AES does not control those third parties and is not responsible for their availability, content, security, or privacy practices. A link is not an endorsement. Your use of any third-party site is subject to that site's terms and privacy notice.
Disclaimer of warranties.
THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, AES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
AES does not warrant that the Website will be uninterrupted, secure, free of errors, or free of harmful components, or that the information on the Website is complete, current, or accurate. Descriptions of services on the Website are general in nature. Actual assignments, availability, scope, and pricing are confirmed only in a separately signed engagement.
Limitation of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, AES AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF AES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE TOTAL AGGREGATE LIABILITY OF AES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, AND NOTHING IN THESE TERMS AFFECTS THE TERMS OF ANY SEPARATELY SIGNED SERVICE AGREEMENT BETWEEN AES AND A CLIENT.
Indemnification.
You agree to indemnify, defend, and hold harmless AES and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of any third party in connection with your use of the Website.
Emergencies.
The Website enquiry form and the published email address are not monitored as an emergency-response service. If you are in an emergency, or if you believe there is an immediate risk to life, safety, or property, call 911. Do not attempt to report an emergency by completing the enquiry form or sending an email; those channels are checked during business hours.
Governing law and disputes.
These Terms and any dispute arising out of or relating to them or your use of the Website are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. You and AES agree that the state and federal courts located in Fairfax County, Virginia have exclusive jurisdiction over any such dispute, and each party consents to the personal jurisdiction of those courts and waives any objection to venue. Nothing in this section limits either party's right to seek injunctive relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or the safety of persons or property.
Other provisions.
These Terms, together with the Privacy Notice and any separately signed engagement, constitute the entire agreement between you and AES regarding use of the Website. If a court holds any provision unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be modified only to the extent necessary. Our failure to enforce a right under these Terms is not a waiver of that right. You may not assign these Terms without our written consent; AES may assign these Terms in connection with a merger, acquisition, or sale of assets.
Changes to these Terms.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Website after an update takes effect constitutes acceptance of the updated Terms. If a material change would meaningfully affect your rights, we will use reasonable means to draw attention to it.
